JEDI-CON 2008 - GENERAL BUSINESS TERMS

As of the date 01-06-2007

1. The Contract
1.1 The Contract for the visit of JEDI-CON 2008 (henceforward called event) is legalized upon registration and upon receipt of complete payment of the Con fees by Miracle Images Verlags GmbH (henceforward designated the organizer)
1.2 The organizer has the right to refuse registration without naming a reason. In the event that the registration had already been confirmed the organizer could annul the contract if evidence is presented, which suggest a future breach of the GBT contract by the visitor.
1.3 The visitor can annul the contract in written form at any time up until and including to December 31, 2007 (postage date). In this case the registration fee shall be refunded in full. After the above-mentioned date the contract can be annulled with full refund of fees only if the organizer cancels the event, if the visitor cannot attend for health reasons (requires written attest by the visitor’s physician), or upon death of the visitor. If the organizer cancels the event at any time, for any reason the registration fee shall be refunded in full, but the organizer shall not be liable for any other consequences caused by cancellation.
1.4 Offering and/or selling of merchandise or services within the framework of JEDI-CON 2008 is permitted only upon receiving written permission by the organizer. Any permission for the sale of merchandise is given only upon signing a separate contract. There is no general right for receipt of such a contract by the visitor.

2. Changes to the Event
2.1 If necessary the organizer has the right to move the event to another location within Germany at any time.
2.2 The organizer has the right to alter any points within the program of the event (including the program in general or any single scheduled events).
2.3 The organizer shall not be held liable for the appearance of any previously announced guest star.
Should a previously announced guest star cancel his or her appearance the organizer shall attempt to find a replacement if at all possible. Under no circumstances can the visitor annul the contract citing the non-appearance of a guest star as a reason.

3. Safety Precautions
3.1 To ensure the personal safety of all persons present at the event, as well as to ensure an unhindered sequence of the program, the following points must be adhered to at all times while participating at the event:
a) The instructions given by security personnel at any time must be adhered to promptly.
b)It is strictly forbidden to carry any weapon, any pyrotechnical equipment, or any other dangerous item(s) while participating at the event. This rule also applies to any item carried as part of a costume or any other props carried to the event. Any item deemed to be potentially dangerous to other participants of the event are to be declared to the security personnel upon entering the event without the necessity of being asked to do so first.
c) It is strictly forbidden to carry any illegal narcotic substances when entering the event.
d) It is strictly forbidden to solicit any political, religious or radical organizations within the framework of the event.
3.2 Refusal to adhere to any of the points listed in 3.1 above may lead to an immediate exclusion of the offender from the event. In this case the visitor shall under no circumstances be refunded for registration fees.
3.3 The security personnel has the right to search personal bags to ensure that the regulations listed under 3.1 and under 5.3 are adhered to.
3.4 The organizer has the right to disallow any ads or solicitation within the framework of the event with stating a reason.
3.5 The organizer has the right to exclude any person from the event if this person presents a danger to him- or herself or to any other participant(s) of the event; or if the person disrupts the unhindered sequence of events on the program; or if this person displays any inappropriate behavior.

4. Liability
4.1 The organizer is liable for any damages only if these damages are a direct result of negligence by the organizer.
4.2 If liability of the organizer has been determined the organizer shall then assume unlimited liability for any damage to a person, to personal wealth or to personal items.
4.3 The organizer shall not assume any additional liability in case of damages done to minors or other persons who physically or legally are unable to make their own decisions. The organizers shall be responsible only for ensuring a generally save environment during the event.

5. Audio-Visual Recordings
5.1. Within the context of the GBT contract audio-visual recordings include any means of capturing speeches, sounds or pictures.
5.2. It is generally permitted to produce audio-visual recordings for personal use only of any part of the event unless otherwise stated. The visitor must ensure that his/her recording of the event does not disrupt the unhindered sequence of the scheduled program in any way.
5.3 The organizer has the right to disallow any audio-visual recording for any part of the program within the event. Non-adherence may lead to immediate exclusion from the current point of program or from the event.
If the organizers had disallowed audio-visual recording due to a contract signed with one of the guest stars (this is especially true in the case of video recordings) the offender shall also be liable for any damages caused by his/her actions (for example a guest star may decide to immediately end his/her appearance due to the incidence).
5.4 The points made under 3.2 concerning exclusion from the event are also applicable here.
5.5 In any event the use of audio-visual recordings for commercial purposes requires written permission by the organizer.
If permission is granted the organizer shall be informed upon publication of the material and shall receive two (2) examples of the publication (in case of printed publication of the material). Publication of audio-visual recordings by electronic means requires written permission by the organizer even if this is done for non-commercial purposes. Any offenders will be prosecuted.
5.6 Logos, symbols, font styles and similar items used during the event are copyrighted and are the exclusive property of Lucasfilm Ltd. Any unsolicited use of these logos, symbols or font styles will be prosecuted.

6. Other
6.1 Invalidation of individual agreements under the GBT contract in no way influence the general validity of the contract.
Invalid contracts shall be replaced or validated after a hearing between both parties has been held and after the point of conflict has been annulled.
6.2 Any additional agreements not covered by the GBT contract must be made in written form.
6.3 The GBT contract once signed cannot be altered.
6.4 Any legal proceedings are the jurisdiction of the Court in Augsburg, Germany.
